If you receive a letter from the NY Compensation Insurance Rating Board indicating that you have been included in their mandatory Industrial Code Rule 59 program, you must comply with several Department of Labor safety specifications.
Failure to comply will result in a 5% INCREASE to your workers compensation premium every year that these specifications are not fully met.
Once you are included in Code Rule 59 you are required to hire an independent, DOL certified Safety and Loss Prevention Consultant to conduct an in depth inspection and review of your safety processes and procedures and file a report with the DOL and your workers compensation carrier which outlines exactly what you must do to earn compliance.
At this point, the inspecting consultant’s responsibilities end and YOU ALONE are required to create, establish and maintain each of the program elements listed in the consultant’s report within CR59's specified timeline. Your carrier will then either deem you in compliance or assess the 5% penalty.
Gold Standard Risk Management will help you earn your Code Rule 59 compliance within the mandated time frame by assisting you in developing and implementing all elements required for compliance as cited in the consultant's evaluation. We will also guide you through the carrier's final inspection. There is no charge for the initial consultation to determine the scope of these services.
If you have not yet completed the initial inspection and evaluation with a certified Safety and Loss Prevention specialist, Gold Standard Risk Management is certified to perform this portion of the CR59 process on your behalf. If we execute the initial inspection and evaluation, we can still assist you with satisfying the report's requirements.
